Member of Former President John Dramani Mahama legal counsel in the ongoing 2020 election petition and Member of Parliament for Bolga East Constituency in the Upper East Region, Hon. Dr. Dominic Ayine says the Chairperson of the Electoral Commission should mount the witness box voluntarily to be cross examined.
Jean Mensa who is the chairperson of the 1st respondent in the election petition is been prevented by the Supreme Court from being cross examined by the lead counsel of the petitioner, Lawyer Tsatsu Tsikata. Despite earlier indications that she will mount the witness box, the court, upon application by the counsel of both the 1st and 2nd respondent, made an unanimous decision to stop her from being cross examined.
However, this has not been welcomed by the counsel for Mahama as they applied to subpoena the EC chair to be cross examined.
For Dominic Ayine who was a former Attorney General, the EC chair should on her own volunteer to enter the witness box and be cross examined just as the respondents did to the three witnesses brought to the court by the petitioner.
According to Dr. Ayine, if Jean Mensah is able to mount the witness box, take oath and tell the truth to Ghanaians, she will be free as the bible says; “tell the truth and the truth shall set you free.”
“In making the declaration on 9th of December, she said; glory to God…that she was giving glory to God for a fair and transparent elections that have been held. Now, there is no better way to glorify God than to tell the truth. The truth is very very important.
If you want to glorify God, you take an oath and you tell the truth…Jean Mensah should voluntarily take the box, tell the truth and that truth will set her free as the returning officer of this elections,” he stated whiles speaking to the media after court proceedings on Monday, February 15, 2021.
